New Administrative Order in Effect Detailing Changes in the Scheduling of First and Second-cause Eviction Actions
The changes are aimed at streamlining the eviction process while ensuring fairness and clarity.
As per the latest provisions:
- Until November 30th, 2023, first-cause eviction actions will continue to be set for hearing at 9:00 a.m., 30 days after the filing date. If the 30-day mark falls on a Court holiday, the hearing will move to the next business day unless the court directs otherwise.
- Starting December 1, 2023, there will be a notable change for first-cause eviction actions. Hearings will be scheduled at 9:00 a.m., 21 days from the filing date, again subject to any specific orders from the court.
- In regards to second cause eviction actions, which deal with money damages claims, these will be scheduled eight weeks from the date of filing, effective December 1, 2023. The scheduling is, as always, subject to any alterations ordered by the court.
The recent changes also mean that any Local Court Rule that conflicts with this new Administrative Order will be amended. Specifically, Housing Court Local Rule 6(J) has been updated to align with the timeframes and mandates set forth in this latest order.
These changes underscore the commitment of court authorities to enhance the efficiency of the eviction process. Parties involved in eviction actions are encouraged to acquaint themselves with the new timelines to ensure timely compliance.
